Adelaide Freedom Rally (AFR) is a community-based group, which has lodged an application for incorporation under the Associations Incorporation Act 1985.

AFR is dedicated to promoting freedom for all. At this time the only effective remedy to stop mandated or coercive medicine for all employees will be to challenge the legal standing of the Directions through a Judicial Review in the Supreme Court of South Australia. There is no guarantee of success, but with so much at stake we are putting together a passionate team of experts to give us the best chance possible. Judicial Review Update

We thank our supporters for all their generous donations so far. We are not there yet with our required funding. Stuart will provide some exciting developments in this update. This is a KEY Adelaide Freedom Rally initiative. This one has legs. Should you want to know how you can help with freedom in South Australia – this is the update for you.

For many of you, you will be no longer able to enter your workplace due to a state direction. We are hurting with you. We will be thinking of the Teachers, Kindy workers, canteen people, school SSOs and child care professionals who are next out the door, last day Friday this week. Simply outrageous treatment right before Christmas.

Make a stand AFR over the next two weeks to support this JR – we have a huge Rally ahead on December 18th. Its our hope to be able to report we have the litigants and funding for a successful JR campaign.

Conditions Applicable to Donations

 

  1. Adelaide Freedom Rally (AFR) is seeking donations (AFR is not a charity) to meet the legal and related costs of proceedings to be issued in the Supreme Court of South Australia. Queens Counsel (QC) legal advice will be obtained.
  2. The only option is recourse to the law, hence legal proceedings in the Supreme Court. There is no guarantee of success, but people who are fighting care.
  3. The government has a lot more public money than AFR. We are the “David”, they are the “Goliath”.
  4. Please note that your contribution will be a donation to the AFR Freedom Fund. Other than for AFR’s internal administration purposes, the name of a donor will not be made known or publicly released unless otherwise advised by the donor.
  5. Your donation will be placed with all other donations in the trust account of Polson Legal.
  6. Any transaction made via the Square online payment platform will incur a 2.2% service fee that will be deducted from your donation. The balance after this deduction will be the amount we receive in the trust account and is what your receipt will reflect.
  7. The conduct of the judicial review application has two separate phases.
    1. First phase: a QC will provide an Opinion as to the merits of a challenge to the Directions which require persons to be vaccinated, other Directions made by the Police Commissioner and the Declaration of Emergency itself. He will also be asked to provide Advice on Evidence.
    2. Second phase: once it is resolved that the application has merit, the Judicial Review will be prepared, filed and served upon the Police Commissioner and other relevant parties.
  8. At the beginning of the second phase the persons who wish to be considered as plaintiffs in the application will be invited to come forward. Those with the necessary standing will be selected.  They will seek to be indemnified for their legal costs from the donations raised by AFR and held in trust, and AFR will give that indemnity.  They will also seek to be indemnified from the risk of an adverse costs order and AFR will also give that indemnity from the donations held in trust.  The total amount of money that is estimated to be necessary for both phases is $150,000.
  9. The people who will institute the legal action are the clients of Polson Legal. Each remain at liberty to make decisions and provide instructions to Polson Legal irrespective of the view of AFR or of donors.  To the extent that any legal or related advice is notified, shared or discussed with a donor, AFR or at a community meeting, that will in every instance be in confidence and without waiver of legal professional or any other privilege
  10. Polson Legal will only pay over, transfer or disburse monies from that AFR Freedom Fund for invoiced legal (and related) costs, expert fees, and related expenses or disbursements that have been reasonably and properly incurred. In addition, minor amounts related to the costs of fundraising and related public and community meetings organised by AFR may be met.
  11. The people who will institute the legal action are the clients of Polson Legal. Each remain at liberty to make decisions and provide instructions to Polson Legal irrespective of the view of AFR or of donors.  To the extent that any legal or related advice is notified, shared or discussed with a donor, AFR or at a community meeting, that is intended in every instance to be in confidence and without waiver of legal professional or any other privilege.
  12. If at the completion or cessation (for whatever reason) of the proceedings (which may include appellate proceedings) there are monies exceeding $1,000 remaining in the AFR Freedom Fund (i.e. surplus funds), donors who have contributed an amount greater than $500 may elect to receive a pro rata return from the surplus funds (i.e. their total donation as a proportion of the total funds raised). Any funds remaining after such pro rata return will be paid to AFR.
  13. AFR is first and foremost a community group seeking to act with individuals and other community groups in the defence of our freedom, especially at this critical time under the Declaration of Emergency.
